In addition, we will share financial and payment information that you provide to us when you purchase a subscription to MatchB2B or a banner advertisement space from MatchB2B with banks relevant to such transaction in order to enable transactions to be completed. In addition, we may use such payment information to determine your credit-worthiness and, in the process of such determination, we may make such payment information available to banks or credit agencies. Any credit card information that you provide through our Website is directly submitted to a payment server of the credit card processing bank. MatchB2B and our agents, affiliates and representatives shall not be liable to you or any other person for, and you hereby release us from, any costs, expenses, liability or other damages that might arise or result from unauthorized use, publication, disclosure or any other misuse of such payment information, including credit card information.4. Publicly Available Information
All information that you provide to be published on our Website or to be shared with other users will be publicly available on the Website and therefore accessible by any internet user or member of MatchB2B, except to the extent that you specifically tell us in your ‘Privacy Settings’ to not make such information public to other members. Subject to that exception, any such information that you disclose to MatchB2B becomes public information and you relinquish any proprietary rights (including but not limited to the rights of confidentiality and copyrights) in such information. You should exercise caution when deciding to include personal or proprietary information in such information that you submit to us.
Your User ID is displayed throughout MatchB2B (and so available to the public), and is connected to all of your MatchB2B activity. Other users can see your Profile, RFBs, Bids, advertisements, forum discussions, feedback, ratings and associated comments. Notices sent to other users about suspicious activity and policy violations on our Website refer to User IDs and specific items. Accordingly, if you associate your name with your User ID, the people to whom you have revealed your name will be able to personally identify your MatchB2B activities.
If you access our Website from a shared computer or a computer in an internet café, certain information about you, such as your User ID, activity or reminders from MatchB2B, may also be visible to other individuals who use the computer after you.
5. Marketing
We do not sell, rent, trade or exchange any personally-identifying information of our users without your explicit consent. However, we may share certain aggregate information based on analysis of Collected Information with our partners, customers, advertisers or potential users. In addition, we may use your Collected Information to execute marketing campaigns, promotions or advertising messages on behalf of third parties; however, in those circumstances, your Collected Information will not be disclosed to such third parties unless you respond to the marketing, promotion or advertising message. We may also combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising. If you do not wish to receive marketing communications from us or participate in our ad-customization programs, simply indicate your preference by following the directions provided with the communication or advertisement.
6. Our Disclosure of Your Information
We may disclose any Collected Information in response to a subpoena or other judicial order or if we reasonably believe that such disclosure is required by applicable law, regulation or administrative order of any court or governmental or regulatory authority.
We may also disclose your Collected Information to any court or governmental or regulatory authority if we have reason to believe that such disclosure is necessary to identify, contact or bring legal action against someone who may be infringing or threatening to infringe, or who may otherwise be causing injury to or interference with, the title, rights, interests or property of MatchB2B, our users, customers, partners, other web site users or any other person who could be harmed by such activities.

- service providers under contract who help with our business operations (such as fraud investigations, bill collection, affiliate and rewards programs and co-branded credit cards);
- other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service);
- law enforcement or other governmental or regulatory officials, in response to a verified request relating to a criminal investigation or alleged fraud, illegal activity, intellectual property infringement or piracy. In such events, we will disclose information relevant to the investigation or proceeding, such as your name, address, telephone and fax number, email address, User ID history, IP address, fraud complaints and bidding history; and
- other business entities, should we plan to merge with or be acquired by that business entity (should such a combination occur, we will request that the new combined entity follow this Privacy Policy with respect to your personal information).
7. Third Party and Co-Branded Partner Relationships
We may, from time to time, establish relationships with other parties to offer you the benefit of other products and services. In doing so, we may offer you access to those other parties either through the use of hyperlinks to their websites from our Website or through offering "co-branded" websites in which both ourselves and those other parties share the same uniform resource locator, domain name or pages within a domain name on the Internet. In some cases, you may be required to submit information for purposes of registering or applying for products or services provided by such third parties or co-branded partners. We encourage you to read the privacy policy of such other parties before responding to any offers, products or services provided by such other parties, as the privacy policy of such other parties may differ from ours, and we may not have any control over the information that you submit to such third parties or co-branded partners.
8. Accessing, Viewing and Changing Your Personal Information
You can access, view and edit your personal information through your account with MatchB2B. Generally, we will not manually modify your personal information because it is very difficult to verify your identity remotely. You must promptly update your personal information if it changes or is inaccurate. Once you make a public posting, you may not be able to change or remove it. Upon your request, we will close your account and remove your personal information from view as soon as reasonably possible, based on your account activity and in accordance with applicable law. We do retain personal information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms of Use, and take other actions otherwise permitted by law.
9. Using Information from MatchB2B
MatchB2B enables you to share personal information with other users. We encourage you to disclose your privacy practices and respect the privacy of other users. We cannot guarantee the privacy or security of your information and, therefore, we encourage you to evaluate the privacy and security policies of your trading partners before entering into a transaction and choosing to share your information. When users are involved in a transaction together, they may have access to each other's name, User ID, email address and other contact and business information. In all cases, you must give other users a chance to remove themselves from your database and a chance to review what information you have collected about them. You agree to use the personal information of another user only for:
- MatchB2B transaction-related purposes that are not unsolicited commercial messages;
- using services or products offered through MatchB2B; or
- other purposes that the user expressly chooses.
10. Minors
Our Website and services are not intended to be targeted to minors under any applicable law and we do not intend to sell any of our services to minors. However, we have no way of distinguishing the age of individuals who access our Website and so we carry out the same Privacy Policy for individuals of all ages. If a minor has provided us with personal information without parental or guardian consent, the parent or guardian should contact us to remove the information.
11. Cookies
